protection legislation, we are an educational consortium with the generic name of Avenor College, formed by the Avenor Foundation as representative of Avenor High School, Avenor Middle School and Avenor Kindergarten, hereinafter referred to as &#8220;AVENOR&#8221;, acting as the controller of personal data. <\/span><\/span><\/p>\r\n<div class=\"source-inline-chip-container ng-star-inserted\">\u00a0<\/div>\r\n<p data-path-to-node=\"10\"><span data-path-to-node=\"10,0\">Our main office is in Bucharest, Drumul P\u0103durea Pustnicu no. <\/span><span data-path-to-node=\"11\"><span data-path-to-node=\"11,1\"><span class=\"citation-621\">Within the framework of its current activities of providing educational services, AVENOR processes the personal data of its employees, candidates for vacant positions, potential, current and former students, but also of their parents or legal representatives, who have the status of data subjects. processing of personal data is carried out by mixed means (manual and automatic), in compliance with legal requirements and under conditions that ensure security, confidentiality, principles and data-path-to-node=\"26,1,0,1\"><span class=\"citation-584\">The schooling contract contains all the provisions necessary for the legal justification of the activities carried out during the education processes, in relations with parents, being reviewed and renewed at the beginning of each school year; <\/span><\/span><\/p>\r\n<div class=\"source-inline-chip-container ng-star-inserted\">\u00a0<\/div>\r\n<\/li>\r\n<li>\r\n<p data-path-to-node=\"26,2,0\"><span data-path-to-node=\"26,2,0,1\"><span class=\"citation-583\">The regulations for organizing various events or competitions may have the role of a contractual provision, if they are well formulated and are brought to the attention of all those involved. <\/span><\/span><\/p>\r\n<div class=\"source-inline-chip-container ng-star-inserted\">\u00a0<\/div>\r\n<\/li>\r\n<\/ul>\r\n<p data-path-to-node=\"27\"><span data-path-to-node=\"27,0\">3. <\/span><span data-path-to-node=\"27,2\"><span class=\"citation-582\">Processing is necessary for the fulfilment of a legal obligation. <\/span><\/span><\/p>\r\n<div class=\"source-inline-chip-container ng-star-inserted\">\u00a0<\/div>\r\n<ul data-path-to-node=\"28\">\r\n<li>\r\n<p data-path-to-node=\"28,0,0\"><span data-path-to-node=\"28,0,0,1\"><span class=\"citation-581\">Labor Code &#8211; Law 53\/2003, Art.39 &#8211; covers the main rights and obligations of the employee; <\/span><\/span><\/p>\r\n<div class=\"source-inline-chip-container ng-star-inserted\">\u00a0<\/div>\r\n<\/li>\r\n<li>\r\n<p data-path-to-node=\"28,1,0\"><span data-path-to-node=\"28,1,0,1\"><span class=\"citation-580\">Accounting Law, and all tax decisions and orders covers requirements related to invoicing, payments, settlement, supporting documents, as well as archiving conditions; <\/span><\/span><\/p>\r\n<div class=\"source-inline-chip-container ng-star-inserted\">\u00a0<\/div>\r\n<\/li>\r\n<li>\r\n<p data-path-to-node=\"28,2,0\"><span data-path-to-node=\"28,2,0,1\"><span class=\"citation-579\">Ministry of Education legislation &#8211; imposes specific requirements for the conduct of activities in state and private educational institutions; <\/span><\/span><\/p>\r\n<div class=\"source-inline-chip-container ng-star-inserted\">\u00a0<\/div>\r\n<\/li>\r\n<li>\r\n<p data-path-to-node=\"28,3,0\"><span data-path-to-node=\"28,3,0,1\"><span class=\"citation-578\">EU Regulation 679\/2016 establishes mandatory elements but also recommendations regarding maintaining compliance in the processing of personal data; <\/span><\/span><\/p>\r\n<div class=\"source-inline-chip-container ng-star-inserted\">\u00a0<\/div>\r\n<\/li>\r\n<li>\r\n<p data-path-to-node=\"28,4,0\"><span data-path-to-node=\"28,4,0,1\"><span class=\"citation-577\">Law 190\/2018 establishes the conditions for the applicability of GDPR in Romania, with special chapters dedicated to the obligation to appoint a DPO and supervision at the workplace. <\/span><\/span><\/p>\r\n<div class=\"source-inline-chip-container ng-star-inserted\">\u00a0<\/div>\r\n<\/li>\r\n<\/ul>\r\n<p data-path-to-node=\"29\"><span data-path-to-node=\"29,0\">4. <\/span><span data-path-to-node=\"29,2\"><span class=\"citation-576\">Processing is necessary to protect vital interests &#8211; was the reporting basis for all decisions taken during the state of emergency adopted in the Pandemic, measures that prevailed over other legal bases and individual freedoms. <\/span><\/span><\/p>\r\n<div class=\"source-inline-chip-container ng-star-inserted\">\u00a0<\/div>\r\n<p data-path-to-node=\"30\"><span data-path-to-node=\"30,0\">5. <\/span><span data-path-to-node=\"30,2\"><span class=\"citation-575\">Processing is necessary for the public interest &#8211; since AVENOR provides educational services considered services of public interest, there may be activities that can be related to this legal basis such as: issuing documents with academic results, assessing the learning capacity and performance of students, adapting teaching activities to individual needs, etc. <\/span><\/span><\/p>\r\n<div class=\"source-inline-chip-container ng-star-inserted\">\u00a0<\/div>\r\n<p data-path-to-node=\"31\"><span data-path-to-node=\"31,0\">6. <\/span><span data-path-to-node=\"31,2\"><span class=\"citation-574\">Processing is necessary for the purposes of the legitimate interests pursued by the operator &#8211; AVENOR refers to this legal basis in order to provide the educational services for which it has committed itself to the highest standards, always for the benefit of students and without violating the rights and freedoms of the data subjects: <\/span><\/span><\/p>\r\n<div class=\"source-inline-chip-container ng-star-inserted\">\u00a0<\/div>\r\n<ul data-path-to-node=\"32\">\r\n<li>\r\n<p data-path-to-node=\"32,0,0\"><span data-path-to-node=\"32,0,0,1\"><span class=\"citation-573\">Organizing the recruitment and selection process in order to hire the best candidates; <\/span><\/span><\/p>\r\n<div class=\"source-inline-chip-container ng-star-inserted\">\u00a0<\/div>\r\n<\/li>\r\n<li>\r\n<p data-path-to-node=\"32,1,0\"><span data-path-to-node=\"32,1,0,1\"><span class=\"citation-572\">Activities to promote the school, college or kindergarten, as well as the results obtained by students; <\/span><\/span><\/p>\r\n<div class=\"source-inline-chip-container ng-star-inserted\">\u00a0<\/div>\r\n<\/li>\r\n<li>\r\n<p data-path-to-node=\"32,2,0\"><span data-path-to-node=\"32,2,0,1\"><span class=\"citation-571\">Organizing charitable fundraising activities, including their promotion; <\/span><\/span><\/p>\r\n<div class=\"source-inline-chip-container ng-star-inserted\">\u00a0<\/div>\r\n<\/li>\r\n<li>\r\n<p data-path-to-node=\"32,3,0\"><span data-path-to-node=\"32,3,0,1\"><span class=\"citation-570\">Executing legal claims, resolving complaints and
